The criminal case filed against Florida DUI / DWI defendants
consists of two different statutes: Florida Vehicle
Code Section 23152 (a), and Vehicle Code Section 23152
(b). The first count focuses on whether the driver was
under the influence of alcohol to the extent that they
are unable to drive their car with the same caution
characteristic of a sober person. This is the legal
standard DUI attorneys consider under the influence
of alcohol in Florida courts.
The
second count, known as the per se charge,
concentrates on whether the drivers blood alcohol
content (BAC) was .08 percent or greater. It is
a charge that is based purely on body chemistry. This
complicates the DUI case for DUI attorneys.
Motorists licensed in other states who are arrested
for DUI / DWI in Florida must request a Florida DMV
hearing to protect their driving privileges. Florida
is one of 45 states that participate in the Interstate
Driver's License Compact, an agreement to share information
about DUI convictions and driver's license actions with
other member states.
Getting arrested for DUI / DWI in Florida can have
harsh consequences, so its critical to have
a Florida DUI attorney with experience defending both
misdemeanor and felony DUI / DWI charges. A skilled
criminal defense
attorney who concentrates on drunk driving cases
can provide a free consultation and develop a proven
defense strategy designed to keep punishment to a minimum.
Florida DUI attorneys have the same opportunity to
receive advanced knowledge & training in various
fields of DUI law as Doctors do in Medicine. In DUI
defense, the more knowledge the DUI attorney has, the
better equipped he is to help you. Here are some points
to discuss with your prospective Florida DUI lawyer:
- Does the lawyer specialize in DUI cases exclusively?
- No ethical attorney will make promises as to a
result in your case.
- Does the quoted fee include DMV hearing, expert
fees, blood reanalysis, trial, etc?
- Insist on a written contract setting forth all costs
and covered services.
- How is the DUI lawyer rated by Martindale-Hubbell?
- Is the DUI attorney Board-certified by the American
Bar Association through the National College for DUI
Defense?
